Here is the plea that Leon County offered me:
1. 6 mos probation
2. 50 hours community service
3. Mandatory Defensive Driving School
4. 1yr License suspension
5. $670.00 fine
I didn't know it until I walked in today but I was charged under criminal statutes - a second degree misdemeanor. There were two assistant state attorneys there. I talked with one trying to convince him that my ticket and the advice that was given to me by the cop verbally were that I was being charged with a civil offense... Wouldn't listen to me.
Finally, just before the judge comes back and I'm looking at getting a lawyer and spending big bucks, I decide to give it one more shot and talk to the state attorney who I can tell is senior because the other guy is asking him questions. He takes a look at my ticket and the copy of the citation that's in his folder. Turns out the clerks are having cops come back and amend tickets - in other words making them notices to appear instead of a civil citation. This kind of upsets the state attorney and he dismisses my charge - no fine nothing. I consider myself very lucky. If the cop had done his job right even the little BS thing that happened to me would have been a very expensive under 30 MPH ordeal.
All I can say is this do not expect to plead out one of these without a good lawyer if the cop has done his homework. They are very serious about this stuff and it simply isn't worth it.
Now I will go slam many beers to celebrate.
PS. Pendragon If your ticket is a notice to appear, do yourself a favor and talk to an attorney and have him there with you at the arraignment.

funny, when I called, they only mentioned the fine... wha tis all the other shit, guess I need to call back...

Look at your ticket. Is it a notice to appear or does it say court appearance not required. If you get a letter in the mail giving you a court date you've been charged under criminal statutes.

it already has a date on the ticket... but I called the court house and they said I would be offered a plea for a fine of 670, they did nto mention the other shit...

OK you are charged with a criminal offense. Are you getting any probation, are they giving you adjudication witheld, (essentially resulting in no criminal charges on your record providing you meet the probation terms). If not yes you might only have to pay a fine but you would also have a criminal charge on your record. I've got to believe at a minimum they're going to assess points on your license. Like I say they'll hand you a plead sheet when you show up. After being there and seeing what goes on I really would recommend getting a lawyer to be there with you if you can afford it. Lawyers like to talk with other lawyers and see then the state is happy because they know that they've cost you money, one way or the other.

And BTW if you don't like their plea you risk a maximum fine of $500.00, plus court costs, and 60 days in jail. Not to mention drivers license revocation etc etc.

Yeah very lucky. But the point is you're dealing with a criminal offense. I wouldn't want to go to criminal court without legal representation. To me the risks are too high. So this charge=expensive no matter what way you look at it. And although I didn't tell the first guy to shove it up his ass I did say "I'll see you in court". They really are cocky assholes though, and I'll tell you I was so pissed at first that I was shaking. It's probably a good thing that the court system used metal detectors. These dicks are eminently shootable.

i dont blame you, i wouldnt take this one on in court by myself either. just saying if they hadnt dismissed it and just given you the plea, i would have told them to lick my asshole
state attorneys are BY FAR much worse than cops
anyone who has had had any dealings with them will agree with me.
without a lawyer they will eat you alive. i hate cops alot, everyone knows this, but state attorneys are a nitch higher on the who i would like to see get run over by a bus list.

This is the exact reason I try to avoid street racing at all times. Its hard sometimes but its just not worth it.

I pealed out... reved up to 2300 rpm and floored it and took off for a sec to practice launching.... then let off still in first... a littel tire spin... nothing that bad.... :)

T you're right. I'm not totally innocent here. It wasn't true street racing but I was messing around, basically punched it and let right off just to jump ahead of this person and then back off.
I do agree with Matt however - at least concerning the exhibition of power. The way the law is written you are guilt of a criminal offense if you chirp your tires. I'm sorry that's a little harsh. I honestly don't think the cop wanted to charge me with a criminal offense and was unaware that the law had changed. He thought he was charging me with a traffic violation. Of course he did later come in and amend the ticket, most likely so he wouldn't look like to much of a dumbass for not knowing the laws that he is supposed to enforce.
The law is definetly a little outrageous. I understand both sides. On the one side they think they are saving lives. And on the other people can get in trouble for just "chirping" their tires. I tell you what it'll make me think twice before I engage in a kind of street "racing"

Believe me I'm going to be pretty careful about driving for awhile. That scared me. I was looking at being out some change and possibly having no license, extremely high insurance bills.
I'm totally reformed and I think I'm trading the Z for a Honda.

I agree, it sucks to know that if you leave a light kinda quick that you could end up with a revoked lic, 6 months probabtion, criminal charges, community service, and a 700 dollar fine. Looks like I will have to shake out the coupe up in GA
