Damn those kids sure get their money's worth out of that class... He probably gets twice as many words out in a lecture as any of my professors ever have. He talks so fast it's almost hard to follow.

Good stuff. I would be one of the people, if I was innocent, to tell em anything they wanted... because since I'm innocent, I have nothing to hide.

You just have to have the frame of mind to think of that at the time. I mean, if a cop showed up on yoru door and said they wanted you for questioning for rape... and you were 10000% innocent, the first thing you're gonna say is your innocent and they have the wrong guy.
Hard to plead the 5th in an unexpected situation like that, ya know?

After having my car searched illegally a year and a half ago, I've been very careful what I say to them.
"Can I search your vehicle."
"Absolutely not."
"Well you can tell me no but I'll just say I smelled drugs or seen weapons or something and search it anyway."
"Call your supervisor, please."
"I am the supervisor."

After having my car searched illegally a year and a half ago, I've been very careful what I say to them.
"Can I search your vehicle."
"Absolutely not."
"Well you can tell me no but I'll just say I smelled drugs or seen weapons or something and search it anyway."
"Call your supervisor, please."
"I am the supervisor."
I have always wondered about that situation. Could you just roll up your windows and lock the door and wait till a different type of LEO showed up or would that be resisting arrest? Could you argue that you didn't think the officer that pulled you over was really a cop if they weren't following the law?

Just because I have nothing to hide, it doesn't mean the 4th & 5th Amendments dont exist. (Illegal search & Seizure/Self Incrimination)
"Do you know why I pulled you over?"
Correct answers:"Yes sir" or "No sir"
Do not volunteer information as it *will* be used against you.
In addition to what everyone else has said:
Know your rights and exercise them, else you will lose them.
Officers often will tell a suspect that if they cooperate, they will be lenient. It's always a lie to get you to incriminate yourself.
In short, it's better to be thrown in the back of a police car and maybe fingerprinted and released than to incriminate yourself.
Oh, and if they give you crap or try to intimidate you. You only need to say the following words to CYA:
"I want to speak to my lawyer". They can't legally question you after that and if they do, it's inadmissible in court.

I never say anything, just give them my license and accept the ticket, they usually get pissy with me bc I give them looks :) but they record most conversations at stops now, so it is wise not to talk.
And I never let them search my car, ever! I agreed to take a breatholizer [sp?] anytime they ask as part of my privilage to drive, other than that, fuck em.

It was followed by this:
"Step out of the vehicle please."
"Is there a problem?"
"There will be if you don't get out of the vehicle NOW!"
I get out and lock the truck.
"Unlock your truck."
"No sir, I don't have to."
"Place your hands behind your back, you're under arrest for failure to follow a police officer's orders."
After that he searched the truck, left it a mess, and further disrespected myself as well as my friend.
I called the PD and filed a formal complaint. I was told the officer has explicit orders NOT to bother me, he can't so much as conduct a traffic stop on me....supposedly.

There is nothing at all saying law enforcement cannot lie. Never say anything without a lawyer, even if they haul you in. They can lie out their asses if they think they can get you to confess or incriminate yourself for anything, doesn't matter if you actually did do anything or not. Also, lie detectors are not admissible in court so never agree to take one. I've learned that through a couple psychologist buddies who deal with law enforcement on a regular basis as part of their practice.

You can have a valid lawsuit against the officer directly as he acted out of the cover of the policy umbrella - he is out there on his own as he was a naughty boy...

Best to keep your mouth shut at any rate. And I will never willingly submit to any type of "Field Alcohol" test, nor will I willingly let them search my vehicle.
